RE:Painter Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and LionByte LLC, a Nevada limited liability company ("LionByte," "we," "us," or "our"), governing your use of the RE:Painter mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy, available at https://www.lionbyteapps.com/repainter-privacy-policy, describes how we handle your data and is incorporated into these Terms by reference.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

2. Your Account

The Service requires you to sign in with your Apple ID. You are responsible for all activity that occurs under your account. You agree not to share your account or use another person's account without permission.

You may delete your account at any time from within the app. Deleting your account permanently removes your projects and forfeits any remaining credits (see Section 6).

3. License to Use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. You may not:

  • copy, modify, distribute, sell, lease, or sublicense any part of the Service;
  • reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
  • use the Service to build a competing product; or
  • access the Service by any means other than the app we provide.

4. Your Content

You own your content. You retain all rights to the photographs you upload, the colorings and paint schemes you create, and the AI-generated visualizations produced from your content (collectively, "User Content").

License to us. So that we can operate the Service, you grant LionByte a limited, worldwide, royalty-free license to host, store, reproduce, and process your User Content solely as needed to provide the Service to you — for example, storing your photos, converting them to line art, and generating visualizations. This license ends when you delete the content or your account, except where retention is required by law.

Your responsibility. You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your User Content does not violate these Terms or any applicable law. You, not LionByte, are solely responsible for your User Content.

5. Acceptable Use

You agree not to upload, create, or attempt to generate content that:

  • is illegal, or promotes illegal activity;
  • depicts or exploits minors in any sexual or abusive manner;
  • infringes any copyright, trademark, or other intellectual property or proprietary right of any person;
  • contains sexually explicit material, graphic violence, or content that harasses, threatens, or degrades any person or group;
  • contains malware or is designed to disrupt or damage the Service; or
  • violates the acceptable-use policies of our technology providers, including Google's Generative AI Prohibited Use Policy.

You further agree not to abuse the Service, including by circumventing credit limits, exploiting the one-time initial credit grant through repeated account creation, using automated tools to access the Service, or interfering with other users' use of the Service.

We reserve the right — but have no obligation — to review, remove, or refuse to process any User Content, and to suspend or terminate accounts that violate this section.

6. Credits and Purchases

The Service uses credits to perform certain actions, such as generating line art and AI visualizations.

  • Purchases through Apple. Credit packs and subscriptions are sold exclusively through Apple's In-App Purchase system. Billing, payment processing, and refunds are handled by Apple under the App Store terms. LionByte does not process payments and cannot issue refunds directly; refund requests must be made through Apple.
  • Initial free credits. New users receive a one-time grant of free credits. This grant is limited to one per person, regardless of account deletion and re-registration.
  • No expiration. Credits do not expire while your account remains active.
  • No cash value; non-transferable. Credits have no monetary value, cannot be exchanged for cash, and cannot be transferred to another account or person.
  • Forfeiture on deletion. If you delete your account, any remaining credits are forfeited without refund or compensation.
  • Changes. We may change credit pricing, allotments, or the number of credits required for a given feature. Changes will not reduce a credit balance you have already purchased.

7. Subscriptions

The ModelKitPainter Pro subscription is an auto-renewable subscription purchased through Apple.

  • Auto-renewal. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your Apple account is charged for renewal within 24 hours before the current period ends.
  • Cancellation. You can cancel anytime in your device's Settings under your Apple ID subscriptions. Cancellation takes effect at the end of the current billing period; no partial refunds are issued by LionByte.
  • Subscription credits. Pro includes a recurring credit allotment as described in the app. Unused subscription credits remain in your account after your subscription ends, subject to the rules in Section 6.
  • Price changes. If subscription pricing changes, Apple will notify you as required and, where applicable, request your consent before charging the new price.

8. AI-Generated Content

The Service uses artificial intelligence to convert photographs to line art and to generate visualizations of painted models. You acknowledge that:

  • AI output is an artistic approximation, not an exact or guaranteed representation of how a physical model will look;
  • AI systems may occasionally produce inaccurate, unexpected, or imperfect results, and credits used for a completed generation are consumed regardless of whether you are satisfied with the artistic result; and
  • due to the nature of AI generation, output produced for you may be similar to output produced for other users.

9. Intellectual Property

The Service itself — including the app, its design, software, and branding — is owned by LionByte and protected by intellectual property laws. These Terms grant you no rights to the Service except the license in Section 3.

Plastic model kits, their designs, and associated names are trademarks and copyrighted works of their respective manufacturers and rights holders. RE:Painter is not affiliated with, endorsed by, or sponsored by any model kit manufacturer. References to model kits within the Service are for descriptive purposes only.

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.

10. Third-Party Services

The Service relies on third-party services, including Apple (distribution and payments), Google Firebase (authentication, storage, and analytics), Google Gemini (AI generation), and RevenueCat (purchase management). Your use of the Service is also subject to any terms those providers impose on end users. We are not responsible for third-party services, and their availability may affect the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIONBYTE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIONBYTE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. LIONBYTE'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY DOLLARS (US $50). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

13. Indemnification

You agree to indemnify and hold harmless LionByte and its officers, members, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) User Content you upload or generate; (b) your violation of these Terms; or (c) your violation of any law or the rights of any third party.

14. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, the license in Section 3 ends and Sections 4 (Your responsibility), 6 (Forfeiture), and 9–17 survive.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. The "Last updated" date at the top reflects the current version.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules.

Talk to us first. If you have a dispute, contact us at contact@lionbyteapps.com and we will try in good faith to resolve it informally within 30 days.

If informal resolution fails, any dispute arising out of these Terms or the Service will be resolved exclusively in the state or federal courts located in Nevada, and you consent to their jurisdiction. Either party may instead bring an individual claim in small claims court where permitted.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction that grants you mandatory rights to the laws and courts of your place of residence, nothing in this section deprives you of those rights.

17. Apple-Specific Terms

These Terms are between you and LionByte only — not Apple Inc. ("Apple"). Apple is not responsible for the Service or its content. You acknowledge and agree that:

  • Apple has no obligation to furnish any maintenance or support for the Service;
  • in the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service;
  • Apple is not responsible for addressing any claims by you or a third party relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims under consumer protection or similar legislation;
  • in the event of any third-party claim that the Service or your possession and use of it infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of the claim;
  • you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government list of prohibited or restricted parties; and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
